TOTAL WIRELESS END USER LICENSE AGREEMENT

1. Agreement

  • Your use of the Total Wireless application (the "App") is subject to this End User License Agreement (EULA).

  • Please read and review this entire EULA before indicating your acceptance of the terms by clicking "Accept" or using the App.

  • Use of Total Wireless, the App, and any related services may also be subject to the Total Wireless Terms and Conditions, including any dispute resolution provisions, and our Total Wireless website Terms of Use or other applicable terms. 

  • Total Wireless grants you the right to install and use the App on a single mobile device or other compatible device owned or controlled by you. The term "App" includes the software application, any updates or upgrades, related documentation, and any services accessible through the application.

2. Device and Password Security

  • You are responsible for maintaining the security of your device and the confidentiality of your password, unlocking code, Personal Identification Number (PIN) code, or other access credentials that you use to access the App.

  • If your device or access credentials are lost, stolen, or used without your permission, please notify us immediately at 1-866-663-3633.

  • Total Wireless is not responsible for any unauthorized access to your account resulting from your disclosure of your access credentials to a third party.

  • You consent to the delivery of codes or other information necessary to access the App by text message, push notification, or other electronic means, unless Total Wireless determines that your device is not capable of receiving such messages.

3. User Preferences

  • The App may allow you to adjust certain user preferences, such as location-based services, marketing communications, and notifications.

  • You can usually find descriptions of these options and change your selections within the App's settings or privacy section.

4. Trademarks

  • You may not use any Total Wireless trademarks or service marks without Total Wireless's prior written permission.

  • For information about usage or licensing, please refer to our Total Wireless website Terms of Use. 

5. U.S. Export Laws

  • Your use of the App and Total Wireless online services is subject to U.S. export control laws and regulations.

  • You represent that you are not a citizen of an embargoed country or a prohibited end user under applicable U.S. export and anti-terrorism laws and regulations.

  • You will not use, export, or allow a third party to use or export the Total Wireless online services in any manner that would violate applicable law, including export control laws and regulations.

  • The App may contain software subject to open-source licenses, and such software is subject to the terms of the applicable licenses.

8. Displayed Pricing and Errors

  • Total Wireless makes reasonable efforts to ensure the accuracy of pricing and product information.

  • Prices and availability are subject to change without notice.

  • All offers are subject to availability and may be withdrawn at Total Wireless's discretion.

  • Total Wireless is not responsible for typographical errors or system failures.

  • Total Wireless reserves the right to correct any errors and to cancel or refuse orders placed at an incorrect price.

9. No Warranties

  • The App and any Total Wireless content are provided "as is" and "as available" and may contain inaccuracies or errors.

  • Total Wireless does not guarantee that the App will be secure, error-free, or uninterrupted.

  • Total Wireless disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 

  • Total Wireless is not liable for any damages, including direct, indirect, incidental, consequential, or punitive damages, arising out of your use of the App. 

10. Changes to this EULA

  • Total Wireless may update this EULA from time to time, without providing advanced notice. Your continued use of the App constitutes your acceptance of the revised EULA.
